How to exercise the right of withdrawal
As established in the Consumer Code – legislative decree 6 September 2005 n.206 and subsequent modifications, such as the Lgs. D . 21 February 2014 – the customer, as stipulated by this legislative decree, reserves the right to withdraw from the contract, without indicating the reason, within 14 days of delivery of the product.
 
Pursuant to art.56, letters d) and e) of the Consumer Code, the consumer loses their right of withdrawal only if they open the bottle of wine in question.
 
The period of withdrawal expires 14 days after the customer, or a third person authorized by the customer (excluding the courier), physically comes into possession of the goods. In order to exercise the right of withdrawal, the customer must inform Orange s.r.l. – Via Noventana,22 – 35027 – Noventa Padovana - ITALY – e-mail : customercare@sunnyfinch.com of their decision to withdraw from the contract via an explicit statement (for example by registered post or by electronic post to: customercare@sunnyfinch.com indicating: the order for which the right of withdrawal has been requested, the identity code (the order number) a summary description of the products, an eventual indication for the refund if a different method is requested from that used for the original purchase.
 
In order to exercise a withdrawal, the consumer can also fill out and send electronically (via e-mail) the form which appears at the end of this subsection, or fill out the active form. If this option is chosen, sunnyfinch will immediately send electronic confirmation (e-mail) of the receipt of the withdrawal. Regarding the terms of withdrawal, the customer should send communication of their decision to withdraw before the end of the period of withdrawal.
 
On exercising the right of withdrawal the customer should indicate: 
 
- The order for which the right of withdrawal has been requested
 
- The date in which the order was placed
 
- The date in which the goods were received
 
- His/her name and surname (as indicated on the order)
 
- His/her address
 
- Add his/her signature (if sent on paper)
 
*** The client has the right to indicate the number of the order in question for the withdrawal and the invoice number emitted by sunnyfinch, and to communicate his/her bank account details for the refund of the sum paid.
 
On receiving this information sunnyfinch will inform the customer about the method for returning the goods, providing a returns code and all the instructions for the return.
 
Effects of withdrawal
 
If the customer consumer withdraws from the contract, sunnyfinch will refund the amount paid for the order in question, including delivery charges (excluding supplementary charges deriving from delivery options different to those offered by us. The money refund will be dealt with rapidly and in any case not more than 14 days after the goods subject to the withdrawal have been returned to sunnyfinch and undergone inspection to verify their integrity. Hence the refund is to be considered suspended until the goods have been returned. Such refund will be made using the same method of payment as used in the initial transaction, unless the client has indicated otherwise. In any case the customer is not subject to any further billing as a result of exercising his/her right of withdrawal (apart from the onus of paying the delivery charges for the return of the goods).
 
In the case of exercising the right of withdrawal subsequent to the shipping or delivery of the goods, the customer must contact info@sunnyfinch.com
 
The requirements for a correct execution of the right of withdrawal are to be considered fulfilled if the customer returns the goods within and not later than the 14 calendar days subsequent to the receipt of the goods. 
 
The customer is entirely responsible for the cost of returning of the goods.
